EU Cosmetics Notification

The European Commission published the EU Cosmetics Regulation (REGULATION (EC) No 1223/2009), which came into force on 11 July 2013 to replace the old Cosmetics Directive (Directive 76/768/EEC) and is implemented as national law in the European Economic Area (EEA) states as well as Norway, Iceland, and Liechtenstein. Regulation (EC) No 1223/2009 on cosmetic products is the main regulatory framework for finished cosmetic products placed on the EU market.

According to the definition of the European Union Regulation, a cosmetic product shall mean any substance or mixture intended to be placed in contact with the various external parts of the human body (epidermis, hair system, nails, lips and external genital organs) or with the teeth and the mucous membranes of the oral cavity with a view exclusively or mainly to cleaning them, perfuming them, changing their appearance and/or correcting body odors and/or protecting them or keeping them in good condition.

Anyone who wishes to place finished cosmetics on EU market must appoint a legal or natural person within the EU to undertake compliance obligations. The responsible person of the cosmetic products submits relevant product information through the online system Cosmetic Products Notification Portal (CPNP) and prepare Product Information File (PIF) before placing the cosmetics in EU market. The submitted information will be available to authorities, poison centers, distributors, and other relevant organizations.
